除额外标注的地方外,R6S百科的所有内容都依照CC BY-NC-SA 4.0[1] 公开发布。这看起来有些复杂,简单地说,转载需要署名,不允许商业使用,并必须以相同的著作权协议发布,这可以确保后续的所有修改均为自由开放的。

在转载R6S百科以及附属站点中任何内容时必须给出原页面的URL链接,并注明文章(全文,部分)从R6S百科转载。

演绎政策

所有在网络上公开发表的,任何人可访问的作品,如作者无明确声明,视为 允许演绎(通俗地讲,允许进行“二次创作”)

作者权利

所有作品会尽量按照作者发布作品时指定的作者名进行注释,对一些难以界定作者的或无法取得作者名的(包括放弃署名权)作者一栏将会留空。(多位作者会全部列出)

对于不再持有作品版权的原作者的要求,R6S百科方面没有版权法上的义务进行处理,但原作者提出的要求会尽量满足。与版权所有者要求冲突时,优先处理版权所有者的请求。

合理使用

合理使用(英语:Fair use),是著作权法的一个概念,允许人们于某些情况下,无需征求著作权所有者的同意,就可以使用受著作权保护的部分内容。“合理使用”这个概念在美国、中国等许多国家的著作权法中都存在。合理使用试图在著作权所有人的利益和公众利益之间取得平衡,在兼顾原创者利益的同时又鼓励新的创造。[3]

合理使用是一种制作未经授权的复制品,以用作一定的保护性的目的的权利。主要包括学术上的使用、教育、写报道、或者写评论。但是这也有一些限定条件,就是所使用的部分相对于该作品的总篇幅来说较短,而且不会有损于该作品的拥有人的经济利益。[4]

中华人民共和国法律中的合理使用

《中华人民共和国著作权法》第二十二条界定了合理使用,摘录如下:

第二十二条
在下列情况下使用作品,可以不经著作权人许可,不向其支付报酬,但应当指明作者姓名、作品名称,并且不得侵犯著作权人依照本法享有的其他权利:

1. 为个人学习、研究或者欣赏,使用他人已经发表的作品;
2. 为介绍、评论某一作品或者说明某一问题,在作品中适当引用他人已经发表的作品;
3. 为报道时事新闻,在报纸、期刊、广播电台、电视台等媒体中不可避免地再现或者引用已经发表的作品;
4. 报纸、期刊、广播电台、电视台等媒体刊登或者播放其他报纸、期刊、广播电台、电视台等媒体已经发表的关于政治、经济、宗教问题的时事性文章,但作者声明不许刊登、播放的除外;
5. 报纸、期刊、广播电台、电视台等媒体刊登或者播放在公众集会上发表的讲话,但作者声明不许刊登、播放的除外;
6. 为学校课堂教学或者科学研究,翻译或者少量复制已经发表的作品,供教学或者科研人员使用,但不得出版发行;
7. 国家机关为执行公务在合理范围内使用已经发表的作品;
8. 图书馆、档案馆、纪念馆、博物馆、美术馆等为陈列或者保存版本的需要,复制本馆收藏的作品;
9. 免费表演已经发表的作品,该表演未向公众收取费用,也未向表演者支付报酬;
10. 对设置或者陈列在室外公共场所的艺术作品进行临摹、绘画、摄影、录像;
11. 将中国公民、法人或者其他组织已经发表的以汉语言文字创作的作品翻译成少数民族语言文字作品在国内出版发行;
12. 将已经发表的作品改成盲文出版。

前款规定适用于对出版者、表演者、录音录像制作者、广播电台、电视台的权利的限制。

Copyright and Similar Rights means copyright and/or similar rights closely related to copyright including, without limitation, performance, broadcast, sound recording, and Sui Generis Database Rights, without regard to how the rights are labeled or categorized. For purposes of this Public License, the rights specified in Section 2(b)(1)-(2) are not Copyright and Similar Rights.

i. Licensed Rights means the rights granted to You subject to the terms and conditions of this Public License, which are limited to all Copyright and Similar Rights that apply to Your use of the Licensed Material and that the Licensor has authority to license.

j. Licensor means the individual(s) or entity(ies) granting rights under this Public License.

k. NonCommercial means not primarily intended for or directed towards commercial advantage or monetary compensation. Section 2 – Scope.

a. License grant.

1. Subject to the terms and conditions of this Public License, the Licensor hereby grants You a worldwide, royalty-free, non-sublicensable, non-exclusive, irrevocable license to exercise the Licensed Rights in the Licensed Material to:

2. Exceptions and Limitations. For the avoidance of doubt, where Exceptions and Limitations apply to Your use, this Public License does not apply, and You do not need to comply with its terms and conditions.

3. Term. The term of this Public License is specified in Section 6(a).

4. Media and formats; technical modifications allowed. The Licensor authorizes You to exercise the Licensed Rights in all media and formats whether now known or hereafter created, and to make technical modifications necessary to do so. 5. Downstream recipients.

C. No downstream restrictions. You may not offer or impose any additional or different terms or conditions on, or apply any Effective Technological Measures to, the Licensed Material if doing so restricts exercise of the Licensed Rights by any recipient of the Licensed Material.

6. No endorsement. Section 4 – Sui Generis Database Rights.

Where the Licensed Rights include Sui Generis Database Rights that apply to Your use of the Licensed Material:

a. for the avoidance of doubt, Section 2(a)(1) grants You the right to extract, reuse, reproduce, and Share all or a substantial portion of the contents of the database for NonCommercial purposes only;

b. if You include all or a substantial portion of the database contents in a database in which You have Sui Generis Database Rights, then the database in which You have Sui Generis Database Rights (but not its individual contents) is Adapted Material, including for purposes of Section 3(b); and

c. You must comply with the conditions in Section 3(a) if You Share all or a substantial portion of the contents of the database.

For the avoidance of doubt, this Section 4 supplements and does not replace Your obligations under this Public License where the Licensed Rights include other Copyright and Similar Rights.

Section 5 – Disclaimer of Warranties and Limitation of Liability

a. Unless otherwise separately undertaken by the Licensor, to the extent possible, the Licensor offers the Licensed Material as-is and as-available, and makes no representations or warranties of any kind concerning the Licensed Material, whether express, implied, statutory, or other. This includes, without limitation, warranties of title, merchantability, fitness for a particular purpose, non-infringement, absence of latent or other defects, accuracy, or the presence or absence of errors, whether or not known or discoverable. b. a. This Public License applies for the term of the Copyright and Similar Rights licensed here. However, if You fail to comply with this Public License, then Your rights under this Public License terminate automatically.

b. Where Your right to use the Licensed Material has terminated under Section 6(a), it reinstates:

1. automatically as of the date the violation is cured, provided it is cured within 30 days of Your discovery of the violation; or

2. upon express reinstatement by the Licensor.

For the avoidance of doubt, this Section 6(b) does not affect any right the Licensor may have to seek remedies for Your violations of this Public License.

c. For the avoidance of doubt, the Licensor may also offer the Licensed Material under separate terms or conditions or stop distributing the Licensed Material at any time; however, doing so will not terminate this Public License.

d. Sections 1, 5, 6, 7, and 8 survive termination of this Public License.

Section 7 – Other Terms and Conditions.

a. The Licensor shall not be bound by any additional or different terms or conditions communicated by You unless expressly agreed.

b. Any arrangements, understandings, or agreements regarding the Licensed Material not stated herein are separate from and independent of the terms and conditions of this Public License.

Section 8 – Interpretation.

a. For the avoidance of doubt, this Public License does not, and shall not be interpreted to, reduce, limit, restrict, or impose conditions on any use of the Licensed Material that could lawfully be made without permission under this Public License.

b. To the extent possible, if any provision of this Public License is deemed unenforceable, it shall be automatically reformed to the minimum extent necessary to make it enforceable.
